1.6 We serve customers located in the United States only. We do not currently offer services to or target individuals located in the European Union, the United Kingdom, Australia, or Canada. This policy is therefore written to comply with applicable United States federal and state privacy laws. Should our business expand to serve customers in other jurisdictions, this policy will be updated accordingly.

We collect this information so that we can identify who you are, communicate with you about bookings, send you confirmations and reminders, respond to your enquiries, and comply with our contractual and legal obligations. This category of information is collected when you make a booking through our website, contact us by telephone or email, or interact with us through a third-party booking platform.

 

3.3 Property and Service Address

 

We collect the address of the property at which you are requesting cleaning services. This is necessary so that our cleaning team can attend the correct location, plan the appropriate service, provide you with an accurate quote, and comply with scheduling requirements. Without your property address, we cannot provide you with our services.

 

3.4 Property Access Information

 

We collect property access codes, key safe numbers, entry instructions, alarm codes, and any other access details you voluntarily provide to us. We collect this information solely for the purpose of allowing our cleaning team to access your property when you are not present, as instructed by you.

 

We recognise that this category of information is particularly sensitive. Property access information is treated as sensitive personal information within our business. Access to this data is strictly limited to authorised personnel who require it to carry out the scheduled service. It is never disclosed to third parties for any commercial purpose. Access codes and key safe numbers are stored separately from other identifying information where possible, so that a data breach of one dataset does not automatically compromise the other. We apply enhanced security controls to this category of data, as described further in Section 10 of this policy.

 

3.5 Booking History and Service Preferences

 

We maintain records of the services we have provided to you, the dates and frequency of those services, your stated preferences (for example, preferred cleaning products, areas of focus, or access arrangements), and any feedback you have given us. We use this information to tailor our services to your needs, provide consistent quality across visits, improve our service offering, and handle any complaints or disputes that may arise.

 

3.6 Payment Card Details

 

We do not directly collect, store, or process your payment card information. When you pay for our services by credit or debit card, your payment details are collected and processed directly by our third-party payment processors, Stripe and Square. We receive only a confirmation of payment and a limited transaction reference. The processing of your payment card data is governed by the privacy policies and security standards of those processors, which are referenced in Section 8 of this policy.

 

3.7 Bank Account Details for Direct Debit

 

Where you have authorised payment by direct debit or ACH transfer, we collect the bank account and routing number information necessary to set up and operate that payment arrangement. This information is used solely for the purpose of collecting payment for services rendered and is stored securely. We do not use bank account details for any other purpose.

 

3.8 Property Photographs

 

With your prior written or documented consent, we may take photographs of your property before and after a cleaning service. These photographs serve legitimate purposes including quality assurance, dispute resolution in the event of a client complaint, staff training (where images are anonymised), and, where you have separately consented, promotional use in our marketing materials.

 

You are under no obligation to consent to photographs being taken. Refusing consent for photography will not affect the service you receive. Where photographs are taken, they will not be shared publicly or used in marketing without your separate, specific, and informed consent to that use. You may withdraw your consent to the use of photographs at any time by contacting us at info@elitenestcleaning.com.

 

3.9 Communications Data

 

We retain records of correspondence between us and you, including emails, notes of telephone conversations, and written communications. We do this so that we have an accurate record of the instructions, agreements, and communications relevant to the services we provide to you.

 

3.10 Website Usage Data

 

When you visit elitenestcleaning.com, we and our third-party analytics partners collect information about how you interact with our website. This may include your IP address, browser type, operating system, pages visited, duration of visit, referring website, and other standard web analytics data. This information is collected using cookies and similar tracking technologies, as described in Section 11 of this policy.

 

3.11 We do not knowingly collect personal information from individuals under the age of 16. Our services are directed at adults. If you believe we have inadvertently collected personal information from a minor, please contact us immediately at info@elitenestcleaning.com so that we can delete it.

(d) In person at your property: When our team attends your property, they may receive or confirm access information and may record details relevant to service delivery.

 

(e) Third-party booking platforms: We may receive your personal information from third-party platforms through which you have made a booking for our services. Where this occurs, those platforms operate their own privacy policies governing the initial collection of your data.

 

4.2 We do not purchase personal information from data brokers or obtain personal information from other third parties for marketing purposes.

SECTION 5: LEGAL BASIS FOR PROCESSING PERSONAL INFORMATION

 

5.1 Under United States privacy law, we are required to identify our lawful justification for collecting and using your personal information. While the United States federal framework does not impose a single unified "lawful basis" requirement in the same manner as the European General Data Protection Regulation, applicable state privacy laws — including the CCPA — require us to be transparent about our purposes and to limit collection to what is reasonably necessary for those stated purposes. The following sets out the justification for each category of processing.

 

5.2 Performance of a contract and provision of services

 

The primary justification for collecting your name, contact details, property address, access information, payment information, and booking history is the need to perform the cleaning services you have requested. Without this information, it is not possible for us to provide you with a service. This is the core operational basis for the majority of our data collection.

 

5.3 Legitimate business interests

 

We collect and retain communications data, booking records, and service history for the purposes of managing disputes, quality assurance, business administration, fraud prevention, and improving our services. These are legitimate business interests which are consistent with what a reasonable client would expect from a professional service provider.

 

5.4 Consent

 

Where we ask you to consent to a specific use of your personal information — such as the taking or use of property photographs in marketing materials, or the sending of marketing communications — we will only use your information for that purpose where you have given us your freely given, specific, informed, and unambiguous consent. You may withdraw your consent at any time, and this will not affect the lawfulness of processing carried out before withdrawal.

 

5.5 Legal obligations and compliance

 

Where we are required by law to retain or disclose personal information — for example, in relation to tax record-keeping requirements or in response to a valid legal order — we process your information on the basis of compliance with our legal obligations.

7.3 You may withdraw your consent to receive marketing communications at any time by:

 

(a) Clicking the "unsubscribe" link included in every marketing email we send; or

 

(b) Emailing us at info@elitenestcleaning.com with the subject line "Unsubscribe"; or

 

(c) Contacting us by telephone and asking to be removed from our marketing list.

 

7.4 We will process your unsubscribe request promptly. Following withdrawal of consent, you may still receive transactional or service-related communications, such as booking confirmations and appointment reminders, as these are necessary for the performance of our services.

 

7.5 We do not sell your personal information to third parties for their marketing purposes. We do not share your personal information with third parties for the purpose of enabling them to market their own products or services to you.

SECTION 8: WHO WE SHARE YOUR PERSONAL INFORMATION WITH

We use the following payment processors to handle payment transactions on our behalf. When you make a payment to us, your payment card or bank account information is processed directly by these providers and is subject to their own privacy policies and security certifications:

 

Stripe, Inc.: Stripe is a payment technology company. When you pay by card through our website or booking system, your payment details are transmitted directly to Stripe. Stripe's privacy policy is available at stripe.com/privacy. Stripe is certified to the Payment Card Industry Data Security Standard (PCI DSS).

 

Square, Inc.: Square is a payment services provider. Your payment card details processed through Square are subject to Square's privacy policy, available at squareup.com/gb/legal/general/privacy. Square is also PCI DSS certified.

 

We do not receive, store, or retain your full payment card number through either of these processors.

 

8.3 Analytics and Advertising Partners

 

We use the following third-party services in connection with our website and online marketing activities. Meta Platforms, Inc. (Facebook Pixel): The Facebook Pixel is a piece of code we have installed on our website that allows us to measure the effectiveness of our advertising on Facebook and Instagram and to enable us to display targeted advertisements to people who have visited our website. Meta's privacy policy is available at facebook.com/privacy/policy.

 

These analytics and advertising tools may involve the collection of data that constitutes "sharing" under California law for the purpose of cross-context behavioural advertising. California residents have the right to opt out of such sharing. Please see Section 12 of this policy and our Cookie Policy in Section 11.

 

8.4 Other Disclosures

 

Beyond the third-party processors listed above, we may disclose your personal information in the following limited circumstances:

 

(a) To our employees and contractors, to the extent necessary for them to perform the services you have requested. Access to sensitive personal information such as property access codes is strictly limited to personnel with a direct need to access it for service delivery.

 

(b) To professional advisers such as accountants, auditors, or legal counsel, where necessary for the operation of our business and subject to professional obligations of confidentiality.

 

(c) To law enforcement agencies, courts, regulators, or other public authorities where we are required to do so by applicable law, court order, or regulatory requirement.

 

(d) To any successor business or entity in the event that we sell, transfer, or merge all or part of our business, provided that the recipient is bound by obligations of confidentiality consistent with this policy.

 

8.5 We do not sell your personal information to third parties for monetary consideration.

 

8.6 Except as described in Section 8.3 with respect to analytics and advertising (which may constitute "sharing" under California law), we do not share your personal information with unaffiliated third parties for the purpose of cross-context behavioural advertising without first providing you with an opportunity to opt out.

SECTION 9: INTERNATIONAL DATA TRANSFERS

 

9.1 We are a United States-based business and our operations are conducted within the United States. We store and process your personal information within the United States.

 

9.2 Some of our third-party service providers, including Google LLC and Meta Platforms, Inc., are large multinational technology companies that may operate infrastructure and store data in multiple countries. Where your personal information is processed by these providers outside of the United States, those providers are responsible for ensuring that adequate protections are in place in accordance with their own privacy commitments and applicable law.

 

9.3 As noted in Section 1.6, we do not currently serve customers located in the European Union or other jurisdictions that impose specific requirements on cross-border data transfers. This section will be updated if our operations change.

SECTION 10: DATA SECURITY

 

10.1 We take the security of your personal information seriously and have implemented a range of technical, organisational, and physical measures designed to protect your personal information from unauthorised access, loss, misuse, disclosure, alteration, or destruction.

 

10.2 Our security measures include, but are not limited to:

 

(a) Storage of electronic records in password-protected systems with access controls limiting access to authorised personnel only.

 

(b) Use of secure, encrypted connections (SSL/TLS) for our website and online forms.

 

(c) Special handling procedures for sensitive personal information, including property access codes and bank account details.

 

(d) A policy of storing property access codes separately from full client names and addresses where operationally feasible, so that these categories of data cannot easily be linked by an unauthorised party.

 

(e) Restricting access to property access information to the specific cleaning team members assigned to your property on the relevant service date.

 

(f) Ensuring that employees and contractors who have access to personal information understand their confidentiality obligations.

 

(g) Using PCI DSS-compliant payment processors to ensure that payment card data is never directly held by us.

 

10.3 While we take reasonable steps to protect your personal information, no method of transmission over the internet or method of electronic storage is completely secure. We cannot guarantee absolute security. In the event of a data breach that is likely to result in harm to affected individuals, we will notify affected individuals and relevant authorities in accordance with applicable law.

 

10.4 You are responsible for keeping any login credentials or account access details relating to our services confidential. Please contact us immediately if you believe that the security of your account or your property access information held by us may have been compromised.

(c) Right to Correct: You have the right to request that we correct inaccurate personal information that we maintain about you.

 

(d) Right to Opt Out of Sale or Sharing: You have the right to direct us to not sell your personal information to third parties for monetary consideration, and to not share your personal information with third parties for the purpose of cross-context behavioural advertising. As described in this policy, we do not sell your personal information. However, our use of analytics and advertising cookies on our website may constitute "sharing" under California law. You may opt out of such sharing by using our cookie consent tool or by submitting a request as described below.

 

(e) Right to Limit Use of Sensitive Personal Information: Where we process sensitive personal information — including property access codes and bank account details — you have the right to direct us to limit our use of such information to the purposes necessary to perform the services you have requested, to ensure security and integrity, or for other uses specifically permitted by the CPRA.

 

(f) Right to Non-Discrimination: We will not discriminate against you for exercising any of your privacy rights. We will not deny you services, charge you different prices, or provide you with a lower level of service because you have exercised your rights under the CCPA or CPRA.

 

(g) Right to Data Portability: In some circumstances, you have the right to receive a copy of the personal information you have provided to us in a portable, usable format.

 

12.4 Rights available to residents of other states

 

An increasing number of US states have enacted their own consumer privacy laws providing rights similar to those described above. 12.5 How to submit a privacy request

12.6 We will acknowledge receipt of your request within a reasonable timeframe and will respond to your request within 30 days of receiving it. Where a request is complex or we have received a large number of requests, we may extend this period by a further 60 days, in which case we will notify you of the extension and the reason for it within the initial 30-day period.

 

12.7 We may need to verify your identity before we can respond to your request. This is to protect your personal information and the personal information of others. We may ask you to provide identifying information that we can cross-reference with the records we hold. We will not require you to create an account with us in order to submit a privacy request.

 

12.8 Where you submit a request through an authorised agent, we may require written evidence of the agent's authority to act on your behalf before processing the request.

 

12.9 We will not charge a fee for processing your request, unless it is manifestly unfounded, excessive, or repetitive, in which case we reserve the right to charge a reasonable fee or refuse to act on the request, in accordance with applicable law.

 

SECTION 13: DATA RETENTION

 

13.1 We retain your personal information for as long as is necessary to fulfil the purposes for which it was collected, as described in this policy, and for as long as required or permitted by applicable law.

 

13.2 Our standard retention period is two years from the date of your last service with us. After this period, we will securely delete or anonymise your personal information, unless we are required to retain it for longer by law or regulation.

 

13.3 Notwithstanding the standard retention period, the following considerations may affect how long specific categories of data are retained:

 

(a) Booking and payment records may be retained for up to seven years from the date of the relevant transaction to comply with applicable federal and state tax and accounting requirements.

 

(b) Communications data and correspondence relevant to a dispute or legal claim will be retained for as long as is necessary to resolve that dispute or satisfy any applicable limitation period for legal claims.

 

(c) Property access information will be deleted promptly upon the conclusion of our service relationship with you, or upon your request, whichever is earlier, except where we are required to retain it for the purposes of an ongoing dispute.

 

(d) Property photographs will be retained in accordance with the purpose for which they were taken. Quality assurance photographs will be deleted within the standard two-year retention period.
